My second crash in 4 years.
The first one was no biggy, just some minor damage and hardly any physical discomfort.

With this one it is kinda turning into a biggy......... :pissed:
Not so much because of injuries, large scratch on my knee, bruises on my left leg and left elbow, but I got away "good" ! :wink:

Story:
February, early in the morning, road was wet because of heavy rain earlier.
I'm on my way to work, no rush, no hurry, I have plenty of time. First meeting is scheduled @ 8:00.

I'm approaching an intersection with traffic lights. I slow down, lights turn green and I make a left turn and kinda stay on the left side of my lane because a car is standing still half on my lane.
Then out of nowhere a cyclist appears, coming straight at me, driving on the wrong side of the road.

automatically you break and steer away, trying to avoid any major collision and half of a second later you realize you are on the ground.
Luckily she (cyclist) is okee, I’m sort of okee.

She mumbles an apology and asks if it is okee for her to continue as she needs to catch her train.

NO WAY!, it is not okee, i see my mirror missing, foot peg is pointing in a strange direction.
I pick up the skoot and try to roll it to the side of the road.
NO WAY i can get the skoot rolling, front wheel is up against the front fork leg, wheel warped, fork in a strange angle.
I pick it up, drag it to the side and we exchange phone numbers.

She gets on her way, i lock up the scooter and continue my way to work with the BUS :pissed:
We exchange some more info via text messages and i contact the insurance company and tell them about the accident.

First reaction of the insurance company is........

It might be a problem to get compensated for damages, she was on a bicycle, and cyclist and pedestrians are legally protected by law because they are the weaker partners in a collision. They get away with almost anything, you should expect that these things can happen.
The only way to claim damages is to proof 100%, without any doubt, that there was absolutely no way you could prevent this, and maybe, just maybe you get half of the total costs :headbashing:

so my legal assistance insurance is on it.

Damage has been estimated by the scooter-place @1200 euro's.
Front wheel, front forks, triple tree, front tire, yoshimura frame brace, mirror and such.

The damage expert of the insurance company came to look it over, says it's okee, rest value of the scoot is high enough.


So now we wait............... and wait..............and wait...............and wait................
Might take up to 3 months, to finally hear I’m not getting anything....


At least i know my blood is still red, and we both walked away without any serious injuries.

sucks to be off the road for that long with no scoot. But as a survivor (knock on wood) of a couple motorcycle crashes that could have been really, really bad, the thing I tell people is "f**k the bike".

If you are going down and you know you are going down, f**k the bike, don't try and keep it up or save it, let it take the damage not your body. I've seen alot of dudes that are going down and they are putting their feet down trying to keep it up... bike ends up on tops of them. You'll get another bike.

I'm glad you are ok. That sucks about the "pedestrian" status of the cyclist. A bicycle is a vehicle and it caused a wreck. Lame.

There is another saying -- "if you leave and go to the train station and leave me here, I can guarantee your bicycle isn't going to look the same when you come back". Feel free to edit it and use it all you want. :banger:

2 months now......

Contacted the insurance company again, requested an update.
Still no reply.

I'm good at waiting.

The good thing is that I got a new bicycle, for free, from an old guy.
It is a triumph, build in the 80's, 3 speed, drumbrakes, stainless steel rims.
Just like the bike I had in my highschool years.

I'm slowly turning it into somekind of retro bike.
Currently looking for a cheap broomstick bar handle bar setup.
I just can't leave things alone, freaking mod-bug.

I got my cycle time home-work / work-home down to about 42 - 45 minutes one way (17 kmph eq 11 mph)

A free 1,5 hour excercise, 5 days a week and I'm actually losing some weight.

recieved an email today, there might be some progress.

keeping fingers crossed,
first claim (all expences) was denied because of the protected status of pedestrians and bicylcle riders.
now a second claim (for 50% of damages, because we were both to "blame") might be approved........
more info next week.......


Time for a funny story: i was clocked in a speed trap doing 28 mph ON MY BICYCLE.
Speed limit for cars was 19 mph (school area).
You can get away with anything on a bicycle.

Seems like everything works out for the bicycle riders there. I guess that's good if you are on a bicycle. I say if you can get a ticket on it for riding it drunk, they should be treated the same! *bangs fist on table*

okee, so the insurance payed almost half of the damage.
out of that spare change i needed to pay the scooterplace for the damage estimate.
so i'm shopping for used now.
used front wheel, used forks, used triple tree, used axle. scooters suck!
but she is at home now (or like my wive says:" it's stinking up the garage again")

yep, the footpeg of my yoshi frame brace was completly ripped of at the weld,
i think i can have it welded again (aluminium).

guess the little thing did what he had to do which is take the blow.
I'm hoping my triple tree is still straight, that might save me a shit load of trouble.
i'm starting with the front fork, axle and rim, see if she is running straight. if not i need the triple tree.
forks are kind of oily on the outside, even if they are straight, if think i still need to replace those. (NCY forks for drum brake).

we'll see..........

the triple tree is a pretty good hunk of steel. If that got bent you really, really hit hard.

But you're right about the parts doing their jobs. The only reason I keep footpegs is because the bike will slide on those rather than the engine (CVT side) or exhaust (exhaust side). I almost never put my feet on them but I'll always have them.
